In Re: On remand from the Louisiana Supreme Court, 19th Judicial District Court, Parish of East Baton Rouge, No. 557359. BEFORE: PETTIGREW, WELCH AND CHUTZ, JJ.

WRIT DENIED. This writ application comes before us on remand from the Louisiana Supreme Court to review the transcript of the trial and the evidence and to determine whether the trial court abused its discretion in granting the motion for new trial. See Martin v. Heritage Manor South, 2000-1023 (La. 4/3/01), 784 So.2d 627. Having done so, we find the trial court did not abuse its discretion in granting the motion for new trial; accordingly, we deny the writ and remand for further proceedings.
