This case was called from the calendar of the Court's February 6, 2023 trial session for Dallas, TX. There was no appearance by or on behalf of petitioner. Respondent appeared and was heard. During the trial session on February 6, respondent filed a Motion to Dismiss for Lack of Prosecution. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is taken under advisement. It is further

ORDERED that, on or before March 8, 2023, petitioner shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution should not be granted and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioner. It is further

ORDERED that the undersigned retains jurisdiction of this case.
