This case is on the calendar of the Court's April 3, 2023 trial session for San Francisco, California. On March 10, 2023, petitioners filed a Motion to Dismiss for Lack of Prosecution. Therein, they represent that they believe the case is susceptible to settlement and have communicated the same to respondent, but have not heard from respondent in more than a year. They further represent that respondent's counsel has not responded to their telephone calls or correspondence.

Upon due consideration, it is

ORDERED that petitioners' Motion to Dismiss for Lack of Prosecution is recharacterized as Motion for Entry of Decision. It is further

ORDERED that on or before March 28, 2023, respondent shall file an objection or response to the Motion. It is further

ORDERED that the Motion is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (PT). Respondent is advised that failure to comply with the terms of this Order or failure to appear at the hearing on April 3, 2023, may result in the Court granting petitioners' motion and entering an order and decision in favor of petitioners.

This Order constitutes official notice to the parties.
