Francisco X. Aguirre Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

James S. Halpern Judge

This case is calendared for trial at the Court's April 11, 2022, Phoenix, Arizona, trial session. Petitioner has moved for Court Appointed Counsel. Each party has moved to continue the case. We will deny petitioner's motion to appoint counsel. See Allen v. Commissioner, T.C. Memo. 2028-24, at *14 (the Court "does not have the power to provide counsel or representative assistance to taxpayers."). In his motion for a continuance, petitioner informs the Court that he expects to be released from prison in May 2023. For that reason, we will not set the case for trial again until after May 2023. It is, therefore, ORDERED that petitioner's motion for Court Appointed Counsel is denied. It is further

ORDERED that petitioner's and respondent's separate motions for continuances are granted, and this case is continued. It is further

ORDERED that on or before September 26, 2022, the parties shall submit a joint status report or separate status reports to inform the Court of the then present status of the above case. It is further

ORDERED that the Clerk of the Court shall not calendar this case until after petitioner's expected release date of February 20, 2023. It is further

ORDERED that this case is stricken for trial from the Court's April 11, 2022, Phoenix, Arizona, trial session.
