SERGIO AGUILAR, Appellant v. SERVICE LLOYD'S INSURANCE, Appellee

On Appeal from the 162nd Judicial District Court Dallas County, Texas Trial Court Cause No. DC-21-01402

ORDER

BONNIE LEE GOLDSTEIN JUSTICE.

By letter dated July 26, 2021, we directed appellant to file a motion for extension of time to file his notice of appeal because it was filed late but within the fifteen-day grace period. See Tex. R. App. P. 26.1(b); 26.3. Before the Court is appellant's August 4, 2021 "First Unopposed Motion for Extension of Time to File Petition for Review." The Court assumes appellant intends this document to be a motion for extension of time to file his notice of appeal. Appellant fails to provide an explanation as to why he did not timely file his notice of appeal. See id. 10.5(b)(1)(C) (must state facts relied on to reasonably explain the need for an extension). Accordingly, we DENY the motion without prejudice to filing, by August 23, 2021, a motion that complies with rule 10.5.

We caution appellant that failure to file a motion that complies with rule 10.5 by August 23, 2021 may result in dismissal of the appeal without further notice.
