ORDER
Pursuant to Tex.R.App.P. 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.
Before the Court is Appellant's third motion for an extension of time to file her appellate brief. In the motion, Appellant states that the trial court has vacated its final judgment. This Court does not have a copy of such an order, which would call into question our appellate jurisdiction over this cause.
Therefore, this cause is ABATED, and all briefing deadlines are suspended. The trial court clerk is ordered to prepare and file a supplemental clerk's record containing all filings in this cause after March 1, 2024. The trial court clerk shall file the supplemental clerk's record on or before June 1, 2024.
The Court requests that the parties file letter briefs addressing any orders in the supplemental clerk's record that may affect this Court's jurisdiction over this appeal. Any such letter brief will be due on or before June 20, 2024. The case will be reinstated once the supplemental clerk's record and any letter briefs are filed. Appellant's third motion for extension of time to file her appellate brief will remain pending during the abatement, and if appropriate, the Court will set a new briefing schedule upon reinstatement. IT IS SO ORDERED this 21st day of May 2024.
