MEMORANDUM OPINION

BILL PEDERSEN, III JUSTICE

Before the Court is Appellant's Unopposed Motion to Dismiss Appeal. Appellant requests the appeal be dismissed with prejudice and that each party bear its own costs of appeal. We grant the motion in all respects and dismiss the appeal. See Tex. R. App. P. 42.1(a)(1).

JUDGMENT

In accordance with this Court's opinion of this date, the appeal is DISMISSED with prejudice.

It is ORDERED that each party bear its own costs of appeal.
