ORDER ADOPTING FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


After making a de novo review, the Court finds that the Findings, Conclusions, and Recommendation of the United States Magistrate Judge are correct and the Findings, Conclusions, and Recommendation are adopted. The statute of limitations for bringing a petition for writ of habeas corpus is equitably tolled from June 5, 2002 to August 23, 2002. Accordingly, the petition is timely. Respondent shall have thirty days from the date of this order to answer the petition on the merits.
