DECISION & ORDER ON MOTION

Motion by appellant, in effect, to compel respondent to file the exhibits, introduced by respondent into evidence at trial, to be included in the record of an appeal from a judgment of the Civil Court of the City of New York, Queens County, entered August 7, 2009, and for an enlargement of time to serve and file a reply brief following the filing of the exhibits.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,

ORDERED that the branch of the motion seeking to compel respondent to file its trial exhibits is granted and respondent shall file said exhibits with this court within 20 days of the date of this decision and order; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to serve and file a reply brief is granted and said brief shall be served and filed within 14 days after the exhibits are due to be filed with this court.
