JUDGMENTS, § 374 — bar to revival by scire facias. Where judgment creditor, a New York corporation, employed an Illinois attorney to collect a money judgment seven years after judgment had been entered, and that attorney, with authority of creditor, effected a settlement and executed and delivered a release and satisfaction to debtor, such settlement was a bar to revival of judgment by proceedings for writ of scire facias subsequently instituted by surviving member of firm of attorneys which represented creditor in original cause of action, notwithstanding that no formal order for substitution of attorneys had ever been entered.
