ANTONIO ADONARIO APPELLANT FERNANDEZ v. THE STATE OF TEXAS STATE
FROM CRIMINAL DISTRICT COURT NO. 1 OF TARRANT COUNTY
TRIAL COURT NO. 1450981D MEMORANDUM OPINION
See Tex. R. App. P. 47.4.
Appellant Antonio Adonario Fernandez pleaded guilty to aggravated sexual assault of a child under fourteen years of age—a first-degree felony with a punishment range of confinement for life or any term of not more than 99 years or less than 5 years and a fine not to exceed $10,000—in exchange for 10 years' confinement. See Tex. Penal Code Ann. § 12.32(a) (West 2011), § 22.021(a), (e) (West Supp. 2016). He now attempts to appeal this conviction.
On August 28, 2017, we notified Appellant that the trial court's certification of his right to appeal states that this is a plea-bargain case, that he has no right of appeal, and that he has waived his right of appeal. We informed Appellant that unless he or any party desiring to continue the appeal filed with the court, on or before September 7, 2017, a response showing grounds for continuing the appeal, the appeal would be dismissed. See Tex. R. App. P. 25.2(a)(2), (d), 44.3. Appellant filed a response, but it does not show grounds for continuing the appeal. Therefore, we dismiss the appeal. See Tex. R. App. P. 25.2(d), 43.2(f).
