DECISION & ORDER ON MOTION

On the Court's own motion, it is

ORDERED that the order on certification dated July 29, 2011, in the above-entitled case is recalled and vacated, and the following order on certification is substituted therefor:

Appeal by the petitioner from an order of the Family Court, Kings County, dated May 13, 2011. Pursuant to Family Court Act §§ 1118 and 1120, and upon the certification of Philip J. Devereaux, Esq., dated July 21, 2011, it is

ORDERED that the respondent Ishmael G., Sr., is granted leave to proceed as a poor person on the appeal, and the following named attorney is assigned as counsel to respond to the appeal on behalf of Ishmael G., Sr.:

Christina Brandt-Young, Esq.
c/o New York Legal Assistance Group
and it is further,

ORDERED that assigned counsel shall promptly attempt to contact the respondent Ishmael G., Sr., at the address provided by the Court, and shall notify the Case Manager assigned to the appeal on or before September 29, 2011, in writing, that she has done so and that either

(1) the respondent Ishmael G., Sr., is interested in responding to the appeal, or
(2) the respondent Ishmael G., Sr., is not interested in responding to the appeal, or that she has been unable to contact him, and wishes to be relieved of the assignment.
