IT IS DIRECTED THAT:

1. The Prothonotary in each county shall no longer maintain a paper file for any pending or hereafter commenced action or matter filed using the LexisNexis File Serve eFile system.

2. Paper files existing as of the effective date hereof for actions and matters commenced prior to June 2, 2008 in Sussex County or prior to October 5, 2009 in New Castle or Kent Counties filed using the LexisNexis File Serve eFile system, pending or closed, shall to be governed by the Court's retention policy dated May, 1985.

3. Paper files existing as of the effective date hereof for actions or matters commenced on or after June 2, 2008 in Sussex County or on or after October 5, 2009 in New Castle or Kent Counties filed using the LexisNexis File Serve eFile system shall be retained until 1 year after final disposition of the action or matter and expiration of the time for appeal without an appeal being filed. The paper file may then be destroyed.
