Present — Peck, P.J., Cohn, Callahan, Van Voorhis and Shientag, JJ.


Order denying defendants' motion to dismiss the first cause of action on the ground that it is barred by the Statute of Limitations, unanimously modified by directing a separate and preliminary trial before the court at Special Term of the issue as to whether or not the cause of action arose in this State and, as so modified, affirmed, with $20 costs and disbursements to the defendants-appellants. Settle order on notice.
