By Notice served May 29, 2024, this case is calendared for trial at the Court's New York City, New York trial session commencing October 28, 2024. On August 26, 2024, respondent filed a Motion to Remand, requesting a remand to the Independent Office of Appeals for further consideration. Also on August 26, 2024, respondent filed a Motion for Continuance, requesting that the case be stricken from the upcoming October 28, 2024 New York City, New York trial session and restored to the general docket to allow more time to conduct a supplemental hearing. Respondent indicates in both motions that petitioners do not object to the granting of the motions.
Upon due consideration, it is
ORDERED that respondent's Motion for Continuance, filed August 26, 2024, is granted in that this case is stricken for trial from the Court's New York City, New York trial session commencing October 28, 2024, and continued with jurisdiction retained by the undersigned. It is further
ORDERED that respondent's Motion to Remand, filed August 26, 2024, is granted and this case is remanded to respondent's Independent Office of Appeals for a supplemental hearing to be held at a reasonable and mutually agreed upon date and time, but not later than November 29, 2024. It is further
ORDERED that, on or before December 27, 2024, the parties shall file with the Court a written report (joint or separate) regarding the then present status of this case. Respondent shall attach thereto any supplemental notice of determination issued to petitioners.
