Pursuant to Florida Rule of Appellate Procedure 9.040(c) (1982) we have elected to treat this cause as an appeal from a denial of post-conviction relief. We affirm. State v. Goodson, 403 So.2d 1337 (Fla. 1981); Mitchell v. State, 381 So.2d 760 (Fla. 5th DCA 1980).

AFFIRMED.
