The reporter's record for this appeal is overdue. The record was originally due October 23, 2024. On October 25, 2024, the Clerk notified the official court reporter that the reporter's record was overdue and directed her to file the reporter's record within 30 days. As of the date of this order, the reporter's record has not been filed.
The clerk's record filed October 10, 2024, includes the Deputy Reporter Statements of court reporter Melissa Maxwell that she worked on this cause on August 8, 2023, and January 5, 2024. The clerk's record also shows the trial court's charge to the jury at the guilt stage of the trial was submitted on June 24, 2024, and sentence was imposed on June 25, 2024. Appellant filed a "notice of appeal and pauper oath" on June 27, 2024. Appellant's counsel filed a request for the reporter's record on July 25, 2024.
Accordingly, we ORDER court reporters Kimberly Xavier and Melissa Maxwell to file the complete reporter's record in this appeal on or before DECEMBER 18, 2024.
We DIRECT the Clerk to send copies of this order to Kimberly Xavier, Official Court Reporter, Criminal District Court No. 3, Dallas County; Melissa Maxwell, Court Reporter; and counsel for all parties.
