Appellant having moved for a stay and for an extension of time to perfect the appeal taken herein from a judgment (denominated "Memorandum Decision and Order") of the Supreme Court entered in the Office of the Clerk of the County of Erie on August 25, 2015,
Now, upon reading and filing the affidavit of James Adams sworn to October 17, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal is granted to the extent that the ordering paragraph of the order of this Court entered September 6, 2016, is hereby amended by deleting the date November 7, 2016, and inserting in its place the date January 6, 2017, and
It is further ORDERED that the motion is otherwise denied.
