ORDER


AND NOW, this 2nd day of May, 2005, upon consideration of petitioner's Petition for Writ of Habeas Corpus (Paper #1), Chief Magistrate Judge Melinson's RR issued on September 1, 2004 (Paper #66), Adams's pro se objections filed on September 17, 2004 (Paper #67), and a September 22, 2004 letter, submitted by Jeffrey M. Lindy, Esq., supplementing Adams's objections, for the reasons stated in the foregoing Memorandum, it is ORDERED:

1. The Report and Recommendation (Paper #66) is APPROVED AND ADOPTED.

2. Petitioner's Objections to Chief Magistrate Judge Melinson's Report and Recommendations (Paper #67) are OVERRULED.

3. Petitioner's Petition for Writ of Habeas Corpus (Paper #1) is DENIED.

4. There is no probable cause to issue a certificate of appealablity.

5. The Clerk of the Court shall mark this case closed.
