ORDER

Diana L. Leyden, Special Trial Judge.

This case is calendared for trial at the June 10, 2024, Albany, New York, Trial Session of the Court.

On May 13, 2024, petitioner filed a Motion to Proceed Remotely (motion). Respondent had no objection to the granting of the motion. On May 20, 2024, respondent filed a Status Report indicating a basis of settlement was reached and that decision documents are being prepared.

By Order served May 24, 2024, the Court directed the parties, on or before May 31, 2024, to show cause in writing, why petitioner's above-referenced motion should not be denied as moot. On May 29, 2024, respondent filed a Response stating that petitioner's pending motion for a remote proceeding is moot. Petitioner did not file a response.

Upon due consideration, it is

ORDERED that petitioner's Motion to Proceed Remotely, filed May 13, 2024, is denied as moot. It is further

ORDERED that the Court's Order to Show Cause dated May 24, 2024, is made absolute. It is further

ORDERED that this case is stricken for trial from the Court's June 10, 2024, Albany, New York, Trial Session. Petitioner is not expected to appear at the calendar call on Monday, June 10, 2024. It is further

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before July 10, 2024, the parties shall submit to the Court stipulated decision documents.
