MEMORANDUM


On September 16, 2004 after a hearing, Magistrate Judge James Melinson filed a Report and Recommendation. The Report and Recommendation had attached to it the usual notice that objections to it had to be filed within ten days. None were filed.

On October 12, 2004 this Court signed an Order approving and adopting the Magistrate Judge's Report and Recommendation denying Ackeridge's Petition for a Writ of Habeas Corpus.

On October 26, 2004 a Pro Se Motion for Reconsideration was filed by Steven Ackeridge. Because Mr. Ackeridge is represented by counsel, Margaret M. Grasso, Esquire, we wrote to her enclosing a copy of the Pro Se Motion and inquiring whether or not she wished to supplement the Motion. See Attachment A. On November 2, 2004 Ms. Grasso responded to the Court's inquiry. See Attachment B.

Before we had an opportunity to deal further with this situation Mr. Ackeridge filed an appeal with the Third Circuit thus removing the matter from our consideration.
