Opinion

Case No. 1DO2-1019

Opinion filed November 14, 2002. Rehearing Denied January 13, 2003.

An appeal from the Circuit Court for Alachua County. Judge Chester B. Chance.

Robert A. Butterworth, Attorney General, and Mark S. Tallahassee, for Appellant.

Dunn, Assistant Attorney General, Leonard E. Ireland, Jr., of Clayton-Johnston, P.A., Gainesville, for Appellee.

Florida Rule of Appellate Procedure 9.1 30(a)(3)(C)(vii) does not provide a basis for exercise of appeal jurisdiction in this case. See State Board of Education v. Azer, 27 Fla. L. Weekly D1932 (Fla. 1st DCA Aug. 28. 2002). Because we decline to review the case pursuant to our certiorari jurisdiction, the case is dismissed.
