An appeal having been taken from an order of the Supreme Court, New York County, entered on or about October 14, 2016 and modified by an order entered on or about October 27, 2016, And defendant-appellant having moved for a stay of enforcement of a certain part of said October 14, 2016 order granting in part plaintiff's motion to compel production of certain documents, pending hearing and determination of the appeal taken therefrom, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the stay articulated in the interim application form dated October 28, 2016 is granted on condition the appeal is perfected on or about January 3, 2017 for the March 2017 Term.
