Abenante v. Star Gas Corporation

Appellate Division of the Supreme Court of New York, Second Department
Dec 27, 2000
278 A.D.2d 438 (N.Y. App. Div. 2000)

Opinion

Argued November 9, 2000.

December 27, 2000.

In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Orange County (Berry, J.), dated October 21, 1999, which denied their motion to strike the defendant's answer and for summary judgment on the issue of liability.

Meiselman, Denlea, Packman Eberz, P.C., White Plains, N Y (James R. Denlea and Stephen L. Fox of counsel), for appellants.

Spiegel, Brown, Fichera Acard, Poughkeepsie, N.Y. (Brian D. Acard of counsel), for respondent.

Before: SONDRA MILLER, J.P., WILLIAM D. FRIEDMANN, GABRIEL M. KRAUSMAN, ANITA R. FLORIO, JJ.

DECISION ORDER

ORDERED that the order is affirmed, with costs.

The plaintiffs failed to demonstrate that the defendant disturbed or destroyed physical evidence that it knew might be needed for future litigation, or that they were prejudiced by any of the defendant's actions. Therefore, the Supreme Court properly denied the plaintiffs' motion (see, Gallo v. Bay Ridge Lincoln Mercury, 262 A.D.2d 450; Popfinger v. Terminix Intl. Co., Ltd. Partnership, 251 A.D.2d 564; Prasad v. B.K. Chevrolet, 184 A.D.2d 626; compare, DiDomenico v. C S Aeromatick Supplies, 252 A.D.2d 41).
