Joseph J. Abdella, Jr Petitioner v. Commissioner of Internal Revenue Respondent

ORDER OF DISMISSAL FOR LACK OF JURISDICTION

Maurice B. Foley Chief Judge

On May 20, 2021, an imperfect petition was filed to commence this case. The Court's $60.00 filing fee was not paid. Accordingly, by Order served August 18, 2021, the Court directed petitioner to file a proper amended petition and pay the Court's filing fee.

On September 20, 2021, the Court filed petitioner's Letter Dated August 24, 2021. Therein, petitioner advises that the parties have resolved their dispute over the underlying tax liability that is the subject of this proceeding and that petitioner no longer intends to pursue the matter in this forum.

Accordingly, it appearing that petitioner does not intend to file an amended petition and pay the Court's filing fee, it is

ORDERED that, on the Court's own motion, this case is dismissed for lack of jurisdiction.
