Appeal from the Monroe Trial Term.

Present — Williams, P.J., Bastow, Halpern, McClusky and Henry, JJ.


Judgment and order unanimously reversed on the law and facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict of the jury was against the weight of evidence.
