Order Denying Abbott's Motion to Bar Evidence Relating to Syntron's Defense Concerning Ownership of the Patents


Abbott seeks exclusion of any evidence that the government or some other entity owns the patents-in-suit or that Abbott is not the rightful exclusive licensee. Abbott's motion is moot to the extent that it requests exclusion of evidence regarding government ownership of Abbott's patents. The Court has already ruled that this evidence is excluded. To the extent that Abbott seeks exclusion of evidence related to the inventorship issue, the motion is DENIED. The Court has adopted the Report and Recommendation which did not exclude evidence of inventorship from trial.

IT IS SO ORDERED.
