On appeal from the 370th District Court of Hidalgo County, Texas ORDER ABATING APPEAL Before Justices Garza, Perkes, and Longoria
Order Per Curiam
This cause is before the Court on the appellants' unopposed motion to abate appeal and extend time regarding formal bill of exception pending mediation. The parties have agreed to mediation which is scheduled on January 25, 2016. Appellants request the Court suspend the deadlines for filing the appellate record and the briefing schedule until February 8, 2016 to allow mediation to occur and the parties an opportunity to resolve this dispute. Appellants also request this Court grant an extension of time to finalize a formal bill of exceptions in the trial court. See TEX. R. APP. P. 33.2(e)(3).
The Court, having examined and fully considered the documents on file and the unopposed motion to abate appeal and extend time to finalize a formal bill of exceptions, is of the opinion that the motion should be granted. The motion to abate the appeal is GRANTED and this appeal is ordered ABATED until February 8, 2016. Accordingly, the deadlines to file the reporter's and clerk's record and the brief schedule are suspended. The motion for an extension of time to finalize appellants' formal bill of exceptions in the trial court is GRANTED until February 8, 2016.
The Court directs appellant to file, on or before February 8, 2016, either (1) a motion to reinstate the appeal, or (2) a motion to dismiss the appeal pursuant to settlement.
PER CURIAM Delivered and filed the 11th day of January, 2016.
