Appeal, No. 76, March T., 1964, from order of Court of Common Pleas of Allegheny County, Jan. T., 1961, No. 1849, in case of A. J. Aberman, Inc. v. White Cunningham, a partnership composed of W. J. White, Jr. and Theodore W. Cunningham. Order affirmed; reargument refused August 21, 1964.
Petition of defendants for an accounting in mortgage foreclosure proceeding.
Order entered dismissing petition, order by BROSKY, J. Petitioners appealed.
Paul Ginsburg, for appellants.
David R. Levin, with him J. Leonard Smith, and Reed, Smith, Shaw McClay, for appellee.
The issues raised in this appeal have been decided by this Court adversely to appellant in two prior decisions. A plethora of motions and petitions by this appellant have also been denied by the lower Court. We find no reason to justify changing our prior decisions or permitting the appellant to relitigate these issues.
Order affirmed and appeal dismissed.
