MOTION DECISION
It is Ordered that the motion of the respondent-appellant seeking an enlargement of time to perfect his appeal is granted. The respondent appellant shall: (1) perfect his appeal on or before the June 2023 term, the filing deadline for which is April 11, 2023, and (2) continue to pay accruing use and occupancy to the landlord-respondent in the amount of $796.66 per month, the amount specified in the most recent lease agreement, on or before each subsequent rental due date, without prejudice.
In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days notice, for an order vacating the stay.
