MEMORANDUM OPINION

Lane's Auto Sales filed a notice of appeal June 30, 2009, from a judgment of forfeiture which was signed June 1, 2009. The clerk's record from this default proceeding was filed July 14, 2009. The appellant's brief was thus due to be filed with this Court on or before August 13, 2009. No brief was filed. On September 11, 2009, we wrote to appellant, warning that unless, within fifteen days of the date of the letter, appellant filed its brief along with a reasonable explanation of the delay, the appeal would be subject to dismissal for want of prosecution.

Appellant has not contacted this Court since filing the notice of appeal. No brief has been filed.

We dismiss the appeal. See Tex. R. App. P. 38.8(a)(1).
