It is Ordered that the motion and cross motion are consolidated for disposition.

It is further Ordered that tenant-appellant's motion is granted on condition that tenant-appellant: 1- perfects his appeal by no later than the October term - the filing deadline is August 7, 2013; 2- pays use and occupancy arrears (from March 3, 2013 to June 16, 2013) to landlord-respondent in the amount of $1,440 on or before June 28, 2013; 3- pays landlord-respondent accruing use and occupancy in the amount reserved in the most recent lease agreement on or before each subsequent rental due date after June 16, 2013, without prejudice. In the event of tenant-appellant's failure to comply with the foregoing conditions, landlord-respondent may move, on five days' notice, for an order vacating the stay and dismissing the appeal.
