An appeal having been taken to this Court from an order and judgment (one paper) of the Supreme Court, New York County, entered on or about September 22, 2022, and said appeal having been perfected, And plaintiff-respondent having moved for the release of funds that were deposited in escrow with appellant's counsel in connection with the stay contained in the order of this Court entered on December 01, 2022 (Motion No. 2022-04225), insofar as the stay is no longer in effect, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of directing the immediate release of the escrowed funds, held by defendant-appellant's counsel, to plaintiff-respondent.
