DECISION & ORDER ON MOTION
Motion by appellant on an appeal from a decision of the Civil Court of the City of New York, Kings County, dated June 11, 2015, to modify a stay granted by decision and order on motion of this court dated August 11, 2015.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that execution of the warrant is stayed on condition appellant deposit into court any and all arrears from October 1, 2015 at the rate of $521.48 per month and continue to deposit into court use and occupancy at a like rate as the same becomes due, and perfect the appeal by December 4, 2015; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
