DECISION & ORDER ON MOTION

Motion by appellant for leave to reargue his opposition to respondent's prior motion to strike the appellant's brief on an appeal from an order of the Civil Court of the City of New York, Queens County, entered January 29, 2014, which prior motion was determined by decision and order on motion of this court dated February 23, 2015, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order on motion of this court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to appellant, if he be so advised, moving in the Civil Court to reconstruct the missing portion of the record.
