DECISION & ORDER ON MOTION

Motion by respondent on an appeal from an order of the Civil Court of the City of New York, Kings County, entered July 19, 2011, to vacate a stay granted by decision and order of this court dated August 22, 2011.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied on condition that within 10 days of the date of this decision and order appellant pay respondent the sum of $1,515.32 and provide landlord with proof of the $901.50 payment claimed to have been made on October 28, 2011; that appellant pay January 2012 use and occupancy in the sum of $1,104.26 on or before January 27, 2012; and that she continue to pay respondent use and occupancy at a like rate on or before the last Friday of each month; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
