It is Ordered that the petitioner-respondent's motion seeking to dismissing the appeal (Saxed, J.), dated November 23, 2015 is granted, unless respondent-appellant perfects her appeal by no later than the March 2017 term - the filing deadline for which is January 11, 2017. In the event of respondent-appellant's failure to comply with the foregoing condition, petitioner-respondent may move on five days' notice for an order dismissing the appeal. The papers submitted as a cross motion, not having been timely served, were considered solely in opposition to the motion (see CPLR 2215).
