An appeal having been taken from an order of the Surrogate's Court, New York County, entered on or about November 29, 2016, And an order of this Court entered on March 30, 2017 (M-641) having granted respondents motion dismiss the aforesaid appeal, unless perfected for the September 2017, And respondents having moved to dismiss the appeal in accordance with the aforesaid order of this Court entered March 30, 2017 (M-641), and for other relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is Ordered that the motion is denied, with leave to renew, upon proof of service of the motion directly upon the appellant, and otherwise denied.
