ORDER

The appellant's brief in this appeal was due on June 6, 2013. When the appellant's brief was not filed, we ordered the appellant, Ed Coburn Linville, to file, on or before July 10, 2013, his appellant's brief and a written response reasonably explaining (1) his failure to timely file the brief and (2) why appellee was not significantly injured by his failure to timely file a brief. We warned appellant that his failure to file a brief and the written response by the date ordered would result in dismissal of this appeal for want of prosecution.

On June 28, 2013, appellant filed a brief and a written response to our order. We are of the opinion that the written response provides a reasonable explanation as required by our order. We, therefore, RETAIN this appeal on the docket of the Court. Appellee's brief is due on July 29, 2013.
