13 HEIN, L.L.C. and Robert P. Hein, Appellant v. Analicia PENA DE BECERRA, Federico Javier Pena Llanos, Lilia Leticia Pena de Borrego, Hilde Pena de Trad, Elsa Pena Cass, Zimmerman Limited Partnership No. 1, Appellee

From the 406th Judicial District Court, Webb County, Texas
Trial Court No. 2014-CVF-001164-D4
Honorable Oscar J. Hale, Jr., Judge Presiding

ORDER

Appellants' third motion for an extension of time to file their brief is granted in part. We order appellants to file their brief by June 21, 2017. Counsel is advised that no further extensions of time will be granted absent a timely motion that (1) demonstrates extraordinary circumstances justifying further delay, (2) advises the court of the efforts counsel has expended in preparing the brief, and (3) provides the court reasonable assurance that the brief will be completed and filed by the requested extended deadline. The court does not generally consider a heavy work schedule to be an extraordinary circumstance. If the brief is not filed by the date ordered, the court may dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(a), 42.3(b), (c).
