Appeals having been taken to this Court from orders of the Supreme Court, New York County, entered on or about July 06, 2021 (Case No. 2021-02498) and on or about July 15, 2021 (Case No. 2021-02664), and from a judgment, same Court, entered on or about August 11, 2021 (Case No. 2021-03073), And 76 11th Lender LLC and XI Mezzanine Lender LLC, by separate motions in each case (M-2021-00200, M-2021-00201, M-2021-00202), having moved, pursuant to CPLR 1018 and 1021, to be substituted for 11th Avenue Lender LLP, as Administrative Agent for and on behalf of 11th Avenue Rep II LP, 11th Avenue MF LP, TCI Rep Co-Inv III LP (formerly known as TCI Rep Co-Investment III LP), and 11th Avenue Lender LLP as plaintiffs-respondents in the action, and for Milbank LLP to be substituted as attorneys on the record for the substituted plaintiffs-respondents in place of Fried, Frank, Shriver & Jacobson LLP, Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is ordered that the motions (M-2021-00200, M-2021-00201, M-2021-00202), are granted and 76 11th Lender LLC and XI Mezzanine Lender LLC be and the same hereby are substituted for 11th Avenue Lender LLP, as Administrative Agent for and on behalf of 11th Avenue REP II LP, 11th Avenue MF LP, TCI Rep Co-Inv III LP (f/k/a TCI REP Co-Investment III LP), and 11th Avenue Lender LLP as plaintiffs-respondents in each case (Case Nos. 2021-02498, 2021-02664 and 2021-03073) and Milbank LLP be and the same hereby are substituted as attorneys of record for plaintiff-respondents in place of Fried, Frank, Shriver & Jacobson LLP.
