An appeal having been taken from an order of the Supreme Court, New York County, entered on or about April 30, 2021,

And defendant-appellant having moved for an order staying all proceedings pending hearing and determination of the appeal, limiting any required bond to the rent as stipulated in the underlying lease agreement as $155,631.89 for the months of February, March and April 2021 and not requiring the posting of a bond for the month of May 2021,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent that the stay is granted on the condition that the defendant-appellant perfects the appeal for the October 2021 Term and either makes payment of rent/use and occupancy for the months of February through and including May 2021 at the base rent or posts an undertaking in the same amount.
