Employer and INTERNATIONAL BROTHERHOOD OF TEAMSTERS UNION, LOCAL NO. 115 Petitioner Case 04-RC-104485 DECISION AND ORDER The National Labor Relations Board has considered objections to a secret mail- ballot election held July 16, 2013, and the Administrative Law Judge's decision recommending disposition of them. The election was conducted pursuant to a Decision and Direction of Election. The revised tally of ballots shows 13 ballots cast for the Petitioner, and 6 ballots cast against the participating labor organization. There were 3 void ballots and 0 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Administrative Law Judge's decision within the time provided. Accordingly, the Board adopts the Administrative Law Judge's findings and recommendations.1 1 The Administrative Law Judge overruled the Employer’s Objections in their entirety, and recommended that the case be remanded to the Regional Director of Region 4 for the purpose of issuing the appropriate certification. 2 ORDER IT IS ORDERED that this proceeding is remanded to the Regional Director for Region 4 for further appropriate action consistent with the Administrative Law Judge's report.
