Nov. 4, 2015) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD UNITED STATES POSTAL SERVICE and Case 05-CA-140963 AMERICAN POSTAL WORKERS UNION, AFL-CIO ORDER1 The General Counsel’s and the Union’s Requests for Special Permission to Appeal Administrative Law Judge Paul Bogas’ order granting Staples, Inc.’s motion to intervene in this proceeding are granted. The complaint does not allege that Staples engaged in unlawful conduct or that any contract between the Respondent and Staples was invalid, nor does it seek relief against Staples. It appears that Staples’ interest is limited to the potential effect of the litigation on Staples, particularly the potential impact of any remedy if the Respondent is found to have violated the Act. Accordingly, the order granting Staples leave to intervene as a party is vacated, and the judge shall consider how best to afford Staples an opportunity, short of full-party status, to address its interest in potential remedial matters.
