POTTER Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered determinative challenged ballots in an election held March 15, 2010, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 10 ballots cast for and 8 ballots cast against the Union, with 2 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued.' The revised tally of ballots shows 10 ballots cast for and 8 cast against the Union, with 2 sustained challenged ballots. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Local Union No. 1999, United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All production and maintenance employees employed by the Employer at its Crawfordsville, Indiana facility; excluding all office clerical employees, administrative employees, professional employees, technicians, service persons, and guards and supervisors as defined in the Act.
