DECISION AND CERTIFICATION OF RESULTS OF ELECTION
The National Labor Relations Board has considered objections to an election
held September 10, 2010, and the Regional Director's report recommending disposition
of them. The election was conducted pursuant to a Stipulated Election Agreement. The
tally of ballots shows 3 ballots cast for and 8 ballots cast against the Petitioner, with 2
challenged ballots, an insufficient number to affect the results.
No exceptions' have been filed to the Regional Director's report within the time
provided. Accordingly, the Board adopts the Regional Director's findings and
recommendations, and finds that a certification of results of election should be issued.
The Petitioner filed timely Exceptions and brief in support and thereafter the Employer filed an
Answering brief to Petitioner's Exceptions. On December 17, 2010, the Petitioner filed a Notice of
Withdrawal of Exceptions to the Report on Objections. The Petitioner's request to withdraw is granted.
Accordingly, the Employer's Answering brief is moot and will not be forwarded to the Board for
consideration.
CERTIFICATION OF RESULTS OF ELECTION
IT IS CERTIFIED that a majority of the valid ballots have not been cast for
International Union of Operating Engineers, Local 150, and that it is not the exclusive
collective-bargaining representative of these bargaining unit employees.
