JUDGMENT


This action came on for a Final Approval Hearing on September 3, 2004 before the Honorable Susan Illston, District Judge Presiding, on Plaintiffs' Motion For An Order Granting: (1) Final Approval Of Class Action Settlement And Plan Of Allocation; (2) Entering Final Judgment; (3) Approving Service Payments To Named Plaintiffs; and (4) approving payment of reasonable Costs To the Claims Administrator; as well as Class Counsel's Motion For Award Of Attorneys' Fees And Reimbursement Of Costs And Expenses. Having fully considered the evidence presented, the issues having been duly heard, and a decision having been duly rendered,

IT IS ORDERED AND ADJUDGED that Judgment be entered on this action, that the action be dismissed on the merits and with prejudice, and that all Settlement Class Members (as that term is defined in paragraph 1.15 of the Settlement Agreement), be and are permanently barred from prosecuting against any Released Parties (as that term is defined in paragraph 1.13 of the Settlement Agreement) any of the Released Claims (as that term is defined in paragraph 1.11 of the Settlement Agreement).

IT IS FURTHER ORDERED AND ADJUDGED that, without affecting the finality of this Judgment in any way, the Court reserves exclusive and continuing jurisdiction over this action, the Named Plaintiffs, the Class, and the Defendants for the purposes of (a) supervising the implementation, enforcement, construction and interpretation of the Settlement Agreement, the Preliminary Approval Order, the Final Judgment, and the Order Granting Final Approval; and (b) ensuring that the terms of the Settlement Agreement are complied with in full, including, but not limited to, the timely and accurate distribution of all monies due to Settlement Class Members, Class Representatives, Class Counsel, and the Claims Administrator, and the timely and accurate distribution of any and all required tax forms.
