Present — Nolan, P.J., Adel, Wenzel, Schmidt and Murphy, JJ.


In an action for divorce, defendant appeals from an interlocutory judgment in favor of plaintiff, after trial. Judgment unanimously affirmed, without costs. In our opinion, the court's comments and participation in the examination and cross-examination of appellant's witness, in the light of all the proof, did not violate any substantial right of appellant.
