ORDER


The court held a hearing on May 7, 2003, on the defendant's motion for partial summary judgment filed April 1, 2003. (Doc. No. 53) The court reserves ruling on that motion until after briefing is complete on the defendant's second motion for partial summary judgment, filed May 2, 2003. (Doc. No. 71) The court notes the defendant's second motion is untimely, as the dispositive motion deadline in this case passed on March 15, 2003, and no motion to extend that deadline has been filed. However, because the issues raised in the second motion must be decided in any event prior to trial, the court waives the untimeliness of the motion.

The plaintiff's deadline to resist the defendant's second motion for partial summary judgment is hereby extended to May 30, 2003.
