Following review of the petition for writ of mandamus and the response thereto, it is ordered that said petition is hereby denied without prejudice to petitioner refiling his request with the clerk together with his affidavit of indigency.

Upon consideration of the motion for sanction, issuance, award of attorney's fees filed by petitioner, it is ordered that said motion is hereby denied.
